Rep. Ro Khanna (D-CA) took issue with comments from Treasury Secretary Janet Yellen, who mentioned invoking the 14th Amendment would spark a “constitutional problem” surrounding the debt ceiling.

The ceiling limits the amount of cash the federal government may just owe. It used to be reached past this year, but Treasury has taken “out of the ordinary measures” to fulfill the u . s . a .’s debt tasks. These measures will exhaust round June 1. House Republicans are attempting to precise spending cuts from President Joe Biden as a situation for raising the limit. If Congress and the White House can’t agree by June, the U.S. will default on its debts for the primary time.

Some handle that Biden does no longer want Congress’ help thanks to the 14th Modification to the Structure, which states:

The validity of the public debt of the USA, authorized by way of legislation, together with money owed incurred for payment of pensions and bounties for services in suppressing rebel or riot, shall now not be questioned.

Appearing on Monday’s Your World on Fox Information, Khanna mentioned he supports the Treasury Department selling more bonds to help fund its obligations – whether or not Congress raises the debt ceiling or now not.

“So that you’re saying the president will have to use this to unilaterally proceed to issue debt if Congress does no longer act,” visitor host Sandra Smith mentioned. “At which level are you saying the president must step in right here? Because they’re about to have talks – Biden and [Speaker Kevin] McCarthy – would you favor they work this out with a deal prior to they transfer in that direction ahead of the president would transfer that route? Are you announcing go at it now?”

“I think they should work it out if imaginable,” Khanna responded. “Obviously, I’m happy that the president’s meeting.”

Smith went on to cite Yellen’s feedback about the 14th Modification method.

“She has also gone on the file saying that it would end in a constitutional difficulty if the 14th modification is invoked,” she stated. “Do you continue to suppose that’s a good idea?”

Khanna replied by way of saying constitutional legislation is not Yellen’s space.

“I’ve quite a few recognize for Secretary Yellen,” Khanna answered. “She’s an economist, now not a constitutional attorney. I place confidence in Larry Tribe, who’s a constitutional attorney. And I if truth be told don’t even assume it requires the invocation of the 14th Modification. I imply, that’s a shield. All of the president has to say is, he’s following the earlier Congress licensed and directed him to do, that this is what Congress advised him to do.”

The congressman went on to say he believes any challenges to the Treasury’s issuance of debt with out Congress’ approval would be rejected by way of the courts.

Khanna didn’t intricate why believes Biden must negotiate with House Republicans and give them concessions if the president is neatly within his rights to disregard them and issue bonds to fulfill its current debt obligations.
